Terms of Service

Clear operating terms for organisations and authorised users using Survetify to manage survey work, project information and AI-assisted risk controls.

1. Agreement and contracting parties

These Terms govern access to the Survetify websites, platform and native mobile applications. Survetify, we, us and our mean the Australian operator identified in the relevant proposal, Order Form or invoice. Customer means the organisation that acquires access. User means a person the Customer authorises to use the service.

The agreement consists of, in descending priority where inconsistent: an executed Order Form or negotiated agreement; any service-specific schedule; these Terms; and incorporated policies. An Order Form may add or replace a term expressly. By signing an Order Form, accepting an invitation or using the service, the Customer and User agree to the applicable agreement.

Survetify is offered for business use. A person accepting for an organisation warrants that they have authority to bind it. Users must be at least 18 years old.

2. The service

Survetify provides software for survey operations management, including projects, requests, scheduling, address and route planning, team access, drawings and revisions, controls, calibrations, field files, records, operational timesheets, Setout close-out, audit history and optional AI-assisted functions. Available functionality depends on the Customer's plan, configuration and role permissions.

We may improve or change features over time. We will not materially reduce the core paid service during a current committed term without reasonable notice, except where a change is reasonably required for security, law, provider availability or to prevent harm. Preview, beta or experimental functions may change or be withdrawn and will be identified where practical.

Survetify is a workflow, information and decision-support platform. It does not perform a registered survey, certify a datum, approve design, replace field verification or take over a Customer's professional, employment, payroll and workplace-safety obligations.

3. Accounts and organisation administration

  • Access is invitation-only and linked to a Customer organisation.
  • The Customer appoints organisation administrators and is responsible for role, project and user access decisions.
  • Users must provide accurate business information, protect credentials and notify the Customer or Survetify promptly of suspected unauthorised access.
  • Accounts are personal to the authorised User and must not be shared.
  • The Customer must remove access promptly when a User changes role or leaves.

The Customer is responsible for activity performed through its authorised accounts except to the extent caused by Survetify's breach of the agreement or failure to apply agreed access controls.

4. Surveying and professional responsibility

The Customer remains responsible for competent professional review and for determining whether information is suitable for field or office use. Without limitation, the Customer must ensure that appropriately qualified personnel:

  • confirm the governing coordinate reference system, datum, grid, zone, geoid, scale and vertical reference;
  • verify current revisions, design status, control integrity, calibration, residuals and tolerances;
  • review source drawings, contracts, specifications and survey instructions;
  • perform independent checks required by law, professional standard, client requirement or safe practice;
  • confirm field conditions, utility information, boundaries and site constraints; and
  • authorise field release, Setout, as-built, machine-control or other deliverables.

Warnings, risk findings, revision alerts and safety gates reduce administrative risk but cannot identify every discrepancy. A missing warning is not confirmation that a drawing, coordinate, control or task is correct or safe.

Travel times, distances, savings and assignment suggestions are estimates and may be affected by traffic, road restrictions, provider coverage, start location and schedule changes. Timesheets record information submitted through the service but the Customer must review them and satisfy its own employment, award, payroll, tax, fatigue-management and recordkeeping obligations before using them for payroll or compliance.

5. AI-assisted features

AI features may extract title-block information, compare records, identify potential conflicts, draft briefings, recommend follow-up or answer project-aware questions. They use probabilistic technology and can produce inaccurate, incomplete, outdated or misleading output.

  • Users must review AI output against original documents and competent professional judgement before relying on it.
  • AI output is not legal, engineering, cadastral, safety or other professional advice and is not a substitute for a licensed or registered practitioner where one is required.
  • The Customer must not use automated output as the sole basis for a decision that may materially affect safety, legal rights, boundaries, construction or financial loss.
  • Survetify may label confidence, evidence and fieldwork-blocking findings, but these indicators are decision aids rather than warranties.

Customers may control AI access through plans, roles and settings. AI processing is also governed by our Privacy Policy.

6. Customer Data and instructions

Customer Data means information, files and content submitted to the service by or for the Customer. As between the parties, the Customer retains ownership of Customer Data. The Customer grants Survetify a non-exclusive licence to host, copy, process, transmit and display Customer Data only as reasonably required to provide, secure, support and improve the service in accordance with the agreement and Privacy Policy.

The Customer warrants that it has the rights, notices, permissions and lawful basis required to supply Customer Data and instruct Survetify to process it. This includes giving personnel any notice required before recording a home or travel-start address, work times, route estimates or productivity information. The Customer must not upload unnecessary sensitive information or material it is prohibited from placing with cloud or AI providers.

We do not intentionally use Customer project content to train a public or general-purpose AI model unless the Customer expressly agrees in writing. We may use aggregated or de-identified operational information that cannot reasonably identify the Customer, a User, project or individual to understand service performance and improve the product.

7. Acceptable use

A Customer or User must not:

  • use the service unlawfully, deceptively or in a way that infringes another person's rights;
  • bypass access controls, probe another tenant, introduce malicious code or interfere with service integrity;
  • share credentials, scrape the service, reverse engineer it except where the law cannot exclude that right, or use it to build a competing dataset or model;
  • upload content without authority or use AI output to impersonate professional certification;
  • send spam, threats, discriminatory or abusive material through the service; or
  • use the service for autonomous high-risk decisions without meaningful qualified human review.

We may investigate suspected misuse and take proportionate protective action. We will provide notice and an opportunity to respond where reasonably practicable unless immediate action is needed to protect people, data, customers or the service.

8. Plans, usage and fees

Plan fees, seats, storage, AI allowance, term, taxes and payment timing are stated in the Order Form. Unless stated otherwise, amounts are in Australian dollars and exclusive of GST. The Customer must pay valid undisputed invoices by the due date.

Founding Customer Pricing. Where this offer is displayed, it is available to the first ten eligible customer organisations that enter a paid Core, Professional or Business subscription and receive written confirmation in an Order Form. For an eligible Customer, the recurring base subscription price of the selected plan is locked for 12 months from the paid subscription start date. The lock does not apply to GST, AI Balance top-ups, excess usage, additional users or storage, add-ons, onboarding or professional services, third-party charges, or a different plan selected later. The offer is limited to one eligible subscription per organisation, is non-transferable, cannot be redeemed for cash or combined with another promotion unless agreed in writing, and ends when ten eligible organisations have accepted it.

AI allowance is a contractual service-usage measure, not money, a deposit, cryptocurrency, gift card or stored-value facility. It is not transferable or redeemable for cash. Any additional allowance is arranged under the Customer's enterprise account or Order Form. Survetify's mobile applications do not offer purchases or direct Users to an external purchasing method.

We will not introduce a new fee during a committed paid term except as agreed or where usage exceeds an agreed limit. Renewal pricing changes require reasonable advance notice. Nothing in these Terms excludes any right or remedy that cannot lawfully be excluded.

9. Privacy, confidentiality and security

Each party must protect the other's confidential information using reasonable care and use it only for the agreement. Confidentiality does not apply to information that is public without breach, independently developed, lawfully received without restriction or required to be disclosed by law after notice where lawful.

Survetify will maintain reasonable technical and organisational safeguards appropriate to the service. The Customer acknowledges shared responsibility for access management, device security, source-document quality, data classification and lawful instructions. Personal information is handled under our Privacy Policy.

10. Availability, support and third-party services

We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, internet conditions, customer systems, mobile platforms and third-party providers may affect access. Any binding service level must be stated in the Order Form.

Survetify depends on providers such as hosting, authentication, AI, email, Apple and Google. We are responsible for selecting and managing providers with reasonable care, but are not liable for an external provider event beyond our reasonable control to the extent we used reasonable continuity and mitigation measures.

Support channels and current response targets are published at survetify.com/support. Response targets are operational goals unless an Order Form expressly makes them a service level.

11. Intellectual property and feedback

Survetify and its licensors own the service, software, designs, documentation, models, workflows and all related intellectual property other than Customer Data. Subject to the agreement, we grant the Customer a non-exclusive, non-transferable right for its authorised Users to access the service during the subscription term.

If a User provides feedback, the Customer permits us to use it without restriction or payment, provided we do not identify the Customer or disclose confidential information without permission. No trademark licence is granted except as expressly agreed.

12. Suspension, termination and data transition

Either party may terminate for a material breach not remedied within 14 days after written notice, or immediately for insolvency where permitted by law. A Customer may also terminate as stated in its Order Form. We may suspend only the affected access or feature where reasonably necessary for security, unlawful use, material risk or undisputed overdue payment, and will restore it promptly when the issue is resolved.

On termination, Users lose access. Subject to security, law and unpaid undisputed fees, we will provide a reasonable opportunity for an authorised Customer administrator to export available Customer Data. We may then delete or de-identify Customer Data through normal operational and backup cycles, except for limited records reasonably required by law, security, billing, disputes or the Customer's written retention instruction.

13. Warranties and liability

Each party warrants it has authority to enter the agreement. We warrant that we will provide paid services with due care and skill. Except for rights and guarantees that cannot lawfully be excluded, the service is provided without implied warranties of fitness for a particular project outcome, error-free AI output or detection of every operational risk.

Australian Consumer Law: nothing in the agreement excludes, restricts or modifies a consumer guarantee, statutory right or remedy that cannot lawfully be excluded. Where permitted for a service not ordinarily acquired for personal, domestic or household use, our liability for breach of a non-excludable guarantee is limited, at our option, to re-supplying the service or paying the reasonable cost of re-supply.

To the maximum extent permitted by law:

  • neither party is liable for indirect or consequential loss, loss of profit, revenue, anticipated savings, goodwill or opportunity, except to the extent such loss was reasonably foreseeable and cannot lawfully be excluded;
  • Survetify is not responsible for loss caused by inaccurate Customer Data, unauthorised account use not caused by our breach, failure to perform required professional checks, or reliance on AI output contrary to these Terms; and
  • each party's aggregate liability arising from the agreement is capped at the fees paid or payable for the affected service in the 12 months before the event giving rise to liability.

The cap does not apply to fraud, wilful misconduct, infringement of the other party's intellectual property, breach of confidentiality, death or personal injury caused by negligence, or liability that cannot lawfully be limited. Liability is reduced to the extent the other party caused or contributed to the loss, and each party must take reasonable steps to mitigate loss.

14. Complaints and disputes

A party must give written details of a dispute and allow senior representatives at least 10 business days to attempt good-faith resolution. If unresolved, either party may propose mediation in Melbourne, Victoria through a mutually agreed mediator before commencing court proceedings. This does not prevent urgent injunctive relief, debt recovery for an undisputed amount or exercise of a statutory right.

15. General

  • Governing law: Victoria, Australia. Courts with jurisdiction in Victoria have non-exclusive jurisdiction.
  • Notices: operational notices may be sent in-app or by email. Legal notices must be sent to the contact in the Order Form and legal@survetify.com.
  • Changes: we may update these Terms with at least 30 days' notice for a material change affecting a current paid term, except a shorter period may apply for law or urgent security. If a materially adverse change is not required by law or security, the Customer may stop renewal or use any termination right stated in the notice.
  • Assignment: neither party may assign the agreement without consent not to be unreasonably withheld, except to an affiliate or successor in a merger, restructure or sale that assumes the obligations.
  • Force majeure: neither party is liable for delay caused by events beyond reasonable control, provided it takes reasonable steps to mitigate and resumes performance promptly.
  • Severability and waiver: an invalid provision is read down or severed only to the minimum necessary. A failure to enforce a right is not a waiver.
  • Entire agreement: the agreement is the complete agreement about its subject matter and does not exclude liability for misleading or deceptive conduct.

Before entering a paid agreement, the registered legal operator name, ABN/ACN and notice details will appear in the Customer's Order Form or invoice.
